If you are a landlord with gas appliances in a rented property, you have legal responsibilities to help keep your tenants safe.

In England, Wales and Scotland, the Gas Safety (Installation and Use) Regulations 1998 place duties on landlords to make sure certain gas appliances, fittings and flues provided for tenants are properly maintained and checked.

What Are a Landlord’s Main Gas Safety Responsibilities?

Landlords are responsible for making sure gas fittings and flues provided for tenants are maintained in a safe condition.

They must also arrange an annual gas safety check on relevant gas appliances and flues provided for tenants’ use.

This work must be carried out by a suitably qualified Gas Safe registered engineer.

The annual gas safety check is required every 12 months.

What Is a Landlord Gas Safety Record?

After the annual gas safety check has been completed, the engineer will provide a record of the inspection.

This is commonly referred to as a landlord gas safety certificate, although the official term is a Landlord Gas Safety Record.

The record normally includes information about the appliances and flues checked, the results of the inspection and details of the Gas Safe registered engineer who completed the work.

When Must Tenants Receive the Gas Safety Record?

Existing tenants must receive a copy of the gas safety record within 28 days of the check being completed.

For a new tenancy, the tenant must be provided with the current gas safety record before they move into the property.

Landlords must also retain records of the checks. HSE guidance states that records should be kept until two further checks have been carried out.

Can a Gas Safety Check Be Done Early?

Yes.

Landlords have some flexibility around the timing of annual checks.

A gas safety check can be carried out during the two months before the existing deadline without losing the original renewal date.

This works in a similar way to an MOT and can make it easier for landlords to arrange access without gradually bringing the annual inspection date forward each year.

Does a Gas Safety Check Replace a Boiler Service?

No.

A landlord gas safety check and a boiler service are not the same thing.

The gas safety check is designed to assess the safety of the relevant gas appliance and flue.

Servicing is focused more broadly on maintaining the appliance in accordance with the manufacturer’s instructions and helping keep it operating correctly.

HSE guidance states that appliances should be serviced in line with the manufacturer’s instructions. If those instructions are unavailable, annual servicing is recommended unless a Gas Safe registered engineer advises otherwise.

For many landlords, arranging the boiler service and landlord gas safety check during the same visit can be a practical option.

Which Gas Appliances Is the Landlord Responsible For?

Generally, landlords are responsible for gas appliances, fittings and flues that they own and provide for the tenant’s use.

This could include:

  • Gas boilers
  • Gas fires
  • Gas water heaters
  • Associated flues
  • Gas pipework provided as part of the property

If a tenant owns their own gas appliance, the landlord is generally not responsible for maintaining that appliance itself, although responsibilities can still apply to the associated installation pipework.

What If a Tenant Will Not Allow Access?

Landlords cannot simply ignore an overdue gas safety check because access has been difficult.

HSE guidance says landlords should be able to show that they have taken all reasonable steps to comply with their duties.

  • Written correspondence with the tenant
  • Notices left at the property
  • Alternative dates offered

A landlord should not force entry into the property.

It is also good practice for tenancy agreements to clearly explain arrangements for access for safety and maintenance work.

Can a Letting Agent Arrange the Gas Safety Check?

Yes.

A landlord may use a letting or managing agent to arrange maintenance and gas safety checks.

The agreement between the landlord and agent should clearly state who is responsible for arranging the work and maintaining the relevant records.

Using an agent does not mean gas safety responsibilities can simply be ignored, so it is important to make sure there is a clear process in place.

Do Landlords Need Carbon Monoxide Alarms?

Carbon monoxide safety is another important consideration for landlords.

In England, landlords are required to provide carbon monoxide alarms in rooms used as living accommodation where certain fixed combustion appliances are present.

The exact requirements can depend on the appliance and property, so landlords should make sure they are following the current regulations alongside their gas safety responsibilities.

What Happens If a Gas Appliance Is Unsafe?

If an engineer identifies an unsafe appliance or installation, the appropriate action will depend on the nature of the problem.

The engineer should explain the issue and what needs to happen next.

Unsafe gas appliances should not continue to be used until the problem has been dealt with appropriately.

Repairs and other gas work must be carried out by a suitably qualified Gas Safe registered engineer.

Why Regular Gas Maintenance Matters

Annual checks are an important legal requirement, but landlords should also pay attention to the general condition of the heating and gas system throughout the tenancy.

Warning signs can include:

  • Boiler pressure repeatedly dropping
  • Unusual boiler noises
  • Heating becoming unreliable
  • Pilot lights repeatedly going out
  • Soot or staining around a gas appliance
  • Unusual condensation
  • Tenants reporting problems with heating or hot water

Issues should be investigated rather than left until the next annual inspection.
